Those circumstances, the court found, could support an inference that the shooter knew others were nearby. A defense attorney then entered a not guilty plea on Robinson\u2019s behalf. Steve Burton of the Utah Defense Attorney Association noted that the judge could have allowed the case to proceed under a lesser murder charge, carrying 15 years to life, but the aggravated count\u2014and the possibility of capital punishment\u2014remained intact.<\/p>\n\n\n\n
Robinson\u2019s lawyers have not publicly presented an alternative account of Kirk\u2019s death, instead concentrating on stopping the trial and removing the death penalty as a possible sentence.
