The NHS computer system, however, could not easily record their family arrangement. When they returned for another appointment, notes reportedly stated that they were not both recognized as Leven’s legal parents in Britain. The couple had planned for their daughter for years and had already been recognized as her parents under the relevant U.S. process. Back home, they discovered that British law viewed their family very differently.

Under current UK rules, the person who gives birth is the child’s legal parent at birth, even when the baby was conceived using a donor egg and the surrogate has no genetic connection. Intended parents must obtain a parental order from a court to transfer legal parenthood, and official guidance requires consent from the surrogate and any other existing legal parent. Frisby and Corbett said their local process could take eight to 10 months, involve extensive paperwork, social-worker visits, and questions about who could authorize medical treatment. They launched a petition demanding reform, attracting more than 113,000 signatures and securing a parliamentary debate—but the government’s response was not what they had hoped to hear.

The couple described the emotional strain of raising Leven while an attorney worked through a court process that would formally establish their shared parental status. Frisby said the uncertainty extended beyond documents: if Leven required urgent medical care, they feared consent might need to come from their American surrogate or the High Court. The parental order is also important for practical matters that can later affect insurance, inheritance, estate planning, and other family protections, although each case depends on its circumstances and legal advice. UK guidance confirms that an overseas birth certificate or foreign court order does not automatically transfer legal parenthood under British law. During the September 7 debate, lawmakers expressed sympathy but also emphasized safeguards for children and surrogates. Public health minister Dame Diana Johnson said the government was not prepared to introduce immediate legislation because of limited parliamentary time, though future options could still be considered.

Frisby and Corbett left Parliament disappointed, saying they felt their personal experience had been overshadowed by a wider argument about exploitation and commercial surrogacy. They stressed that they were not seeking fewer protections for surrogates, but a system that also recognizes the realities faced by children and intended parents. Their case highlights the difficult balance confronting lawmakers: preserving meaningful consent and welfare checks while preventing families from spending months in uncertainty after a child is already home. For Leven, daily life continues with the two fathers who feed her, comfort her, and take her to medical appointments. Yet legally, their journey remains unfinished until the parental order is granted. The debate produced no immediate change, but it placed a deeply personal question before the country—how quickly should the law recognize the family already caring for the child?

The receptionist’s question stopped Jamie Corbett in his tracks: “Who are the mother and father?” He explained that baby Leven, born in the United States in January…

[1

post-55952","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-uncategorized
["GET
