A 70-year-old California man is seeking $35 million from the city of San Diego after a serious sidewalk accident that his attorney says could have been prevented. The man reportedly suffered severe injuries, including a broken neck and back, after tripping in the Mission Hills neighborhood on May 11. According to his lawyer, William M. Berman, the injuries have changed his life and require him to receive around-the-clock medical care while recovering at home. Security footage from a nearby business allegedly captured the moment the man, who was using a walking aid, caught his foot on an exposed metal parking meter base sticking out from the sidewalk. The parking meter itself had reportedly been removed months earlier, but the base remained in place, creating what the attorney described as a dangerous condition. The fall caused the man to hit his face against his vehicle, resulting in serious injuries.
Berman has filed a claim against the city, arguing that San Diego failed to properly maintain its sidewalks and remove hazardous objects left behind in public areas. He claims similar exposed parking meter bases exist in other neighborhoods and says his client hopes the lawsuit encourages better sidewalk safety. Local residents have also expressed concerns about uneven sidewalks and obstacles that can create risks, especially for elderly people and those using walkers or mobility devices. One resident said tree roots and damaged walkways already make certain areas difficult to navigate, while another warned that people could easily fall if they are not careful. The city of San Diego responded that it cannot comment on individual claims or possible legal action.
